Description
Negotiate and prepare multiple forms of agreements with utilities, public agencies, and other private entities who wish to encumber Watco's property for wirelines, pipelines, drainage, private roadways and other similar or related temporary uses in such a manner to ensure the safety and integrity of Watco's property.
Manage applications and agreements to ensure compliance with policies, operating procedures, and agreement terms. This position will work cross-departmentally with Engineering, Industrial Development, Service Solutions, Sales, Logistics, Legal, Environmental, Operations, and Billing and Collection Teams.
Primary Accountabilities of The Position
- Manage and negotiate pipeline, wireline, drainage, right of entry, public and private crossings, and other third-party agreements.
- Manage and maintain review and approval of new utility, road crossing, and encroachment applications from Watco’s Engineering, Sales, Law, Environmental, Storage, and Operating personnel.
- Draft and review license and easement agreements in a manner to maximize income, reduce liability exposure and conform to Watco’s Operating, Engineering and Safety requirements and practices.
- Maintain each license and contract record with updates and changes as required.
- Conduct field audits to ensure proper use and occupancy.
- Recognize and resolve unauthorized uses of Watco property. Negotiate licenses with unauthorized parties or initiate legal processes to discontinue unauthorized use.
- Collect delinquent rentals and evict licensees in default; authorize bills payable/bills collectible.
- Resolve wireline, pipeline, drainage, road crossing and right of entry issues and disputes system wide.
- Maximize income by ensuring that all contracts and licenses provide for highest appropriate fees through internal and external valuation resources.
- Serve as real estate expert on all operating, abandoned, surplus, excess, and newly acquired property in territory. Research and review maps and deeds relative to title questions and right-of-way boundaries.
- Serve as back up to other Real Estate Managers.

Duties And Responsibilities
- Assist all Watco team members or outside parties with any questions on new or existing licenses.
- Manage new requests, locate new opportunities, and renegotiate existing agreements.
- Identify underutilized properties and assist in determining profitable outcomes.
- Understand all right of way widths, acreage, and leased and owned miles on each assigned railroad.
- Develop an understanding of all real estate properties.
- Identify potential environmental issues and engage Watco Environmental prior to state interaction.
- Conduct market research as part of real estate due diligence frequently utilizing paid subscription services, public resources, and the internet.
- Identify property rights associated with leased and owned property and understand what entity has what ownership rights.
Integration Plan
- Introduce and educate Watco’s operating and marketing teams on Real Estate’s handling of wireline, pipeline, fiber optic, cellular tower or billboard licenses, and other potential revenue producing markets along our profit center right of ways.
- Mitigate Watco’s risk and exposure by coordinating with our operations and track maintenance teams to schedule the entry of third parties and contractors needing access to our property.

Education And Experience
Bachelor’s Degree required. Desired experience three years:

Ability to interpret a variety of instructions furnished in written, oral, diagram, or schedule form. Understand diverse customer traffic patterns and markets in order to identify best property and negotiate real estate solutions.
